Spousal Pressure to Leave Parents Deemed Cruelty by Madras HC

Spousal Pressure to Leave Parents Deemed Cruelty by Madras HC

The Madras High Court has issued a significant ruling, stating that compelling a husband to separate from his parents and establish an independent residence amounts to cruelty within a marriage. This decision provides clarity on family obligations in marital disputes.

The judgment was delivered in a case involving a husband who was the only son. The court noted that he had moved out of his family home following his wife’s insistence on setting up a separate household.

Further observations by the court highlighted that the wife’s consistent and unexplained visits to her maternal home contributed to an environment of insecurity within the marital relationship.
